These Terms and Conditions (“Terms”) govern your access to and use of the Boss Up & Glow website, courses, certification programs, digital materials, communities, services, and physical products.
Throughout these Terms, “Boss Up & Glow,” “we,” “us,” and “our” refer to [Nelvy Aesthetics LLC d/b/a Boss Up & Glow]. “You” and “your” refer to the person purchasing, accessing, or using our products or services.
By visiting our website, creating an account, submitting payment, checking the acceptance box at checkout, or accessing our materials, you acknowledge that you have read, understood, and agreed to these Terms and our Refund Policy and Privacy Policy.
If you do not agree to these Terms, do not purchase or use our products, programs, or services.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to purchase or participate in our courses and programs.
Certain professional product trainings and facial certification programs are intended exclusively for appropriately licensed beauty or wellness professionals. Depending on the program, this may include licensed estheticians, master estheticians, cosmetologists, barbers, massage therapists, nail professionals, or other qualified professionals.
You are responsible for confirming that you possess all licenses, permits, insurance, training, and legal authority required to perform any service in your location.
We may request proof of identity, professional licensure, insurance, or other qualifications before granting access to a professional certification program or issuing a certificate.
2. Educational Purpose
Our courses, trainings, certification programs, workbooks, demonstrations, templates, and resources are provided for educational and informational purposes only.
Unless expressly stated otherwise, Boss Up & Glow is not an accredited college, university, trade school, or licensing authority. Completion of one of our programs does not:

Grant or replace a professional license

Expand your legally authorized scope of practice

Guarantee approval from a licensing board, employer, insurer, or skincare company

Qualify you to perform services prohibited by applicable law

Constitute legal, medical, financial, accounting, tax, or insurance advice
You remain responsible for understanding and complying with the laws, regulations, professional standards, sanitation requirements, and scope-of-practice rules applicable to you and your business.
When professional guidance is needed, you should consult an appropriately licensed attorney, accountant, insurance professional, healthcare provider, or other qualified adviser.
3. Certification Requirements
Receiving a certificate may require completion of all assigned lessons, assessments, product training, demonstrations, live-model practice, submissions, meetings, or other requirements identified for the applicable program.
Submitting payment or accessing a program does not guarantee certification. We may withhold a certificate until all requirements have been completed to our reasonable satisfaction.
A Boss Up & Glow certificate recognizes completion of our private educational program. It is not a government-issued license, academic degree, or guarantee of professional competency.
You must only perform techniques that fall within your legal scope of practice and level of training. You are responsible for obtaining appropriate client consent, screening for contraindications, following manufacturer instructions, maintaining sanitation and safety standards, and carrying adequate professional and general liability insurance.
Unless a particular program states otherwise, certification remains valid for two years. Updated education, proof of continued eligibility, or recertification may be required to maintain active certification status.
4. Assumption of Professional Responsibility
Beauty and wellness services may involve risks, including irritation, allergic reactions, bruising, infection, burns, injury, unexpected skin responses, or other adverse outcomes.
You accept full responsibility for how you apply the information and techniques taught in our programs. You are solely responsible for evaluating clients, obtaining informed consent, recognizing contraindications, selecting appropriate products and equipment, and responding to adverse reactions.
If you perform a treatment on a live model, you are responsible for ensuring that the model has voluntarily consented and is an appropriate candidate for the service.
Boss Up & Glow does not supervise your independent professional practice and is not responsible for services you provide to clients or models.
5. Accounts and Access
You are responsible for providing accurate account information and maintaining the confidentiality of your username and password.
Your account and course access are personal to you. You may not share your login information, permit another person to access your account, or purchase one enrollment for use by multiple employees or practitioners.
Each professional who watches, uses, or becomes certified through a program must purchase or receive their own authorized enrollment unless we provide written authorization for a team or business license.
Notify us immediately at samantha@bossupandglow.com if you believe your account has been accessed without permission.
Course access will be provided for 18 months from purchase, unless a different period is clearly stated on the applicable sales page. “Lifetime access” is not provided unless expressly stated in writing.
Access may depend on third-party platforms, including ClickFunnels, Vimeo, payment processors, or other service providers. Temporary interruptions caused by maintenance, outages, updates, or circumstances outside our reasonable control do not constitute grounds for a refund.
6. Payments and Payment Plans
You agree to pay all prices, taxes, shipping charges, and other fees disclosed at checkout.
If you select a payment plan, you authorize us and our payment processor to charge the payment method provided according to the payment schedule disclosed at checkout.
A payment plan divides the total purchase price into installments; it is not a month-to-month subscription that may be canceled before the remaining balance is paid. You remain responsible for the entire purchase price after receiving access, even if you stop participating, do not complete the program, or no longer wish to use it.
If a scheduled payment fails, we may retry the payment, request an updated payment method, suspend your access, withhold certification, or pursue the unpaid balance as permitted by law.
You agree to contact us first at samantha@bossupandglow.com to attempt to resolve any billing concern. Nothing in these Terms prevents you from exercising a legitimate right provided by your bank, card issuer, or applicable law.
7. Refunds and Returns
All purchases are governed by our separately posted Refund and Return Policy, which is incorporated into these Terms.
Because digital course materials and proprietary resources may be made available immediately after purchase, sales of courses, trainings, certifications, downloads, and other digital products are final and nonrefundable except where otherwise required by law.
Eligible physical-product returns must comply with the time limits and conditions stated in our Refund and Return Policy.
Please review the complete Refund and Return Policy before making a purchase.
8. Intellectual Property
All course videos, treatment protocols, techniques, frameworks, presentations, scripts, photographs, graphics, manuals, workbooks, templates, downloads, checklists, forms, branding, website content, and other materials provided by Boss Up & Glow are owned by or licensed to Boss Up & Glow and are protected by intellectual-property laws.
Your purchase provides you with a limited, personal, nonexclusive, nontransferable, revocable license to access and use the materials for your own education and professional business operations, subject to these Terms.
Unless we provide express written permission, you may not:

Copy, reproduce, record, download, or distribute course videos

Share course materials, logins, protocols, or downloads with another person

Upload our content to another website, platform, drive, group, or course

Resell, sublicense, publish, or commercially distribute our materials

Teach, demonstrate, certify, or train others in our proprietary techniques or certification methods

Create a competing course, certification, protocol, or training based substantially on our materials

Remove copyright, trademark, watermark, or ownership notices

Represent our materials or methods as your own creation

Use the Boss Up & Glow name, branding, or certification marks without authorization​

You may use designated client-facing protocols, business templates, or marketing resources in your own business only to the extent expressly permitted with those materials.
Unauthorized use may result in immediate termination of access and other remedies available under law.
9. Brand and Product Information
Some trainings may discuss or feature third-party skincare brands, products, devices, experts, manufacturers, or service providers. Brand participation, formulas, protocols, pricing, availability, and professional-partner requirements may change.
References to third-party products do not guarantee their continued availability, suitability for every client, or approval for use within your jurisdiction.
Always review current manufacturer instructions, ingredient information, warnings, contraindications, and professional-use requirements before using a product or device.
Unless expressly stated, third-party companies do not own, operate, sponsor, or control Boss Up & Glow.
10. Business and Earnings Disclaimer
Boss Up & Glow does not guarantee that you will earn a particular amount of revenue, gain a specific number of clients, obtain financing, open a business, become profitable, or achieve any particular professional result.
Examples, projections, testimonials, and student experiences are provided for illustrative purposes only. They are not promises or representations that you will achieve the same outcome.
Your results depend on numerous factors outside our control, including your experience, effort, market, pricing, location, business decisions, expenses, licensing, implementation, and economic conditions.
You accept full responsibility for your personal and business decisions.
11. Community Standards
If your purchase includes access to a community, coaching space, live call, or group, you agree to communicate professionally and respectfully.
You may not:

Harass, threaten, intimidate, or discriminate against another participant

Post unlawful, defamatory, sexually explicit, or harmful material

Spam members or promote unrelated products and services without permission

Collect or use another participant’s personal information without consent

Share confidential information or content from the community outside the program

Infringe another person’s intellectual-property or privacy rights
-
Disrupt sessions or interfere with another participant’s experience
We may remove content or revoke community access when reasonably necessary to protect participants, our business, or the integrity of the program.
Nothing in these Terms prohibits an honest review, lawful report, or communication protected by applicable law.
12. Participant Content
You retain ownership of original content you submit to us.
By voluntarily submitting assignments, questions, comments, photographs, videos, or other materials within a program, you grant us the limited permission necessary to review, store, display, and use that content to provide and administer the program.
We will not use your name, likeness, testimonial, treatment results, or identifiable images in public advertising without separate permission, except where you have intentionally made the content publicly available or applicable law otherwise permits its use.
Do not upload confidential client information, client photographs, or model content unless you have obtained all necessary written permissions.
13. Physical Products and Shipping
Product availability, pricing, and delivery estimates are subject to change. We may limit quantities or cancel an order if a product is unavailable, incorrectly priced, suspected to involve fraud, or prohibited from shipment.
Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, incorrect addresses, customs, supply disruptions, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address. Additional shipping charges caused by an incorrect address or refused delivery may be your responsibility.
Please inspect physical products promptly after delivery and report damaged, defective, or incorrect items within the period stated in our Refund and Return Policy.
14. Website and Third-Party Services
Our website may contain links to third-party websites, products, affiliate recommendations, software, or services. We do not control those third parties and are not responsible for their content, privacy practices, availability, terms, or performance.
Some links may be affiliate links, meaning we may receive compensation if you make a purchase through the link. Where required, affiliate relationships will be disclosed.
Your use of a third-party platform or product is governed by that provider’s own terms and policies.
15. Prohibited Conduct
You may not use our website, programs, products, or services to:

Violate any law, licensing rule, regulation, or professional standard

Commit fraud or provide false information

Circumvent access controls or security features

Introduce malware or interfere with website operations

Scrape, harvest, or improperly collect data

Impersonate another person or misrepresent your qualifications

Infringe intellectual-property, confidentiality, publicity, or privacy rights

Engage in conduct that could harm Boss Up & Glow, its partners, instructors, or participants

MARKETING COURSE — INDIVIDUAL LICENSE AND ACCOUNT ACCESS

Your enrollment in The BOSS Launchpad includes access to a separately licensed marketing course. Boss Up and Glow pays a $500 licensing fee for each student account created for this marketing course. Your license is limited to one account for your personal use.
You may not share the private marketing-course registration link, create more than one account, allow another person to register through your link, or share your login credentials, course access, or licensed marketing materials.
All accounts created through your unique registration link are monitored and connected to your enrollment. If you create or permit an additional or unauthorized marketing-course account through your link, you will be responsible for reimbursing Boss Up and Glow the full $500 licensing cost incurred for each additional account.
Unauthorized account creation, access, or sharing may also result in the immediate suspension or termination of your marketing, course and BOSS Launchpad access without a refund. By using the private registration link, you acknowledge and agree to these licensing and account access requirements.
16. Suspension and Termination
We may suspend or terminate access if you materially violate these Terms, fail to make required payments, share protected materials, compromise account security, engage in unlawful or unsafe conduct, or threaten the safety or rights of others.
When practical, we may provide notice and an opportunity to correct a non-serious violation. Immediate action may be taken for serious safety, payment, confidentiality, intellectual-property, or misconduct concerns.
Termination resulting from your violation does not eliminate an outstanding payment obligation and does not entitle you to a refund.
Sections concerning payment obligations, intellectual property, disclaimers, liability, and dispute resolution will survive termination.
17. Disclaimer of Warranties
To the fullest extent permitted by law, our website, educational materials, programs, and services are provided on an “as is” and “as available” basis.
We do not warrant that the website or course platform will always be uninterrupted, error-free, secure, or compatible with every device. We do not guarantee that all information will remain current or that every method, product, template, or strategy will be appropriate for your circumstances.
Nothing in this section excludes a warranty or consumer right that cannot legally be excluded.
18. Limitation of Liability
To the fullest extent permitted by law, Boss Up & Glow and its owners, employees, instructors, contractors, affiliates, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, professional claims, or client-related losses arising from your participation or use of our materials.
To the fullest extent permitted by law, our total liability for a claim relating to a specific purchase will not exceed the amount you actually paid to Boss Up & Glow for that purchase.
These limitations do not apply where liability cannot legally be limited or excluded.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Boss Up & Glow and its owners, employees, instructors, contractors, affiliates, and partners from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:

Services you perform or products you use with your clients or models

Your violation of a law, licensing rule, professional obligation, or these Terms

Your misuse or unauthorized distribution of our materials

Content you submit or publish

Your infringement of another person’s rights
This section does not require you to indemnify a party for conduct that cannot legally be indemnified.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to send written notice describing the dispute to samantha@bossupandglow.com and allow both parties at least 30 days to attempt to resolve the matter informally.
Unless applicable law requires otherwise, any legal action relating to these Terms must be brought in a court of competent jurisdiction located in Salt Lake County, Utah, and each party consents to that court’s jurisdiction.
Nothing in this section prevents either party from seeking appropriate relief for intellectual-property infringement, unauthorized access, fraud, or an immediate threat of harm.
21. Changes to Programs and Terms
We may update course materials, instructors, schedules, product references, platform features, bonuses, or program delivery when reasonably necessary.
We may also update these Terms to reflect changes in our operations, services, or legal obligations. The updated version will be posted with a revised “Last Updated” date.
Changes will apply prospectively unless otherwise permitted or required by law. If a material change affects an active paid program, we will provide reasonable notice when required.
22. Force Majeure
We are not responsible for a delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, illness, emergencies, labor disruptions, internet or platform outages, carrier delays, government actions, or failures of third-party providers.
23. Severability and Waiver
If any portion of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
24. Entire Agreement
These Terms, together with the applicable sales page, checkout disclosures, Refund and Return Policy, Privacy Policy, and any signed program agreement, constitute the entire agreement between you and Boss Up & Glow regarding the applicable purchase.
If a separately signed agreement directly conflicts with these Terms, the signed agreement will control for that specific subject.
